A Texas resident has sued Lotte Hotel Guam and its insurer for serious personal injuries that resulted in hospitalization, when she slipped and fell on a wet and slippery floor of the Tumon hotel in August, according to a complaint of negligence filed in federal court on Monday.

Elaine M. Rodriguez, through her attorneys Victorino DLG. Torres and Matthew J. Holley, said the incident happened around 11:30 a.m. on or about Aug. 28, as she stepped out of Lotte Hotel Guam’s elevator. She was staying at the hotel as an in-house guest at the time.

“There was no protective carpet where Plaintiff fell. There were no signs or adequate signs to warn its customers, invitees or guests of the dangerous condition,” according to the lawsuit, which names Lotte Hotel Guam LLC and ABC Insurance Company as defendants.

The lawsuit says Rodriguez “suffered serious personal injuries, which required hospitalization under the care of professional medical staff.” Besides incurring medical expenses at the time and in the future, the plaintiff also said in her complaint that she sustained severe pain and suffering and emotional and mental distress, “and has suffered diminished quality of life.”

The plaintiff seeks compensatory damages for medical care and expenses, bodily injury and special damages in the amount to be proven at trial and in excess of $75,000, as well as other relief to which she is entitled to.
